Andy and Toba Barth are the Property Owners and you are the Guest(s).

 

EXCHANGE OF MONEY AUTOMATICALLY CONSTITUTES ACCEPTANCE OF ALL TERMS AND CONDITIONS SET FORTH HEREIN.

 

TRAVEL INSURANCE IS OFFERED ON OUR PROPERTY Ivacationonline.com WEBSITE for renters to purchase at the time of reservation.

 

A.  Travel Guard Travel Insurance:  IF YOU THINK THAT THERE IS ANY POSSIBILITY THAT YOU MAY HAVE TO CANCEL THIS TRIP THEN PLEASE TAKE ADVANTAGE OF THIS OPTION AND DO NOT RELY ON OUR CANCELLATION POLICY TO REIMBURSE ANY AMOUNT DUE TO AN UNFORSEEN HAPPENSTANCE. 

B. Travel Guard Damage Insurance:  For $49.00 the property is covered up to $3,000.00 accidental damage costs, and pet damage is covered.

 

 

WE SUGGEST THAT ALL MEMBERS OF THE GROUP RENTING AND STAYING IN OUR HOME READ THIS LICENSING AGREEMENT SO ALL UNDERSTAND THE TERMS AND CONDITIONS OF THIS AGREEMENT.

 

We, Andy and Toba Barth,  are the owners of 10 Canvasback and we are the renting agents for our house.

The property will be ready for occupancy at 5:00 PM local time on the beginning date of the lease and must be vacated by 9:30 AM local time on the ending date of the lease.  During high season, some units may not be ready by 5 p.m., your patience is appreciated.

 

If you arrive before CHECK-IN TIME and the house is not ready when you arrive at the premises, please understand that our cleaning staff only has a few hours to clean their assignments on "changeover day" and we are meticulous when it comes to cleaning.  Additionally, we try to address any maintenance problems (e.g.air conditioning, bathroom and kitchen repairs, etc.) during that time so that you are not disturbed during your stay.

 

If you do arrive early to Hilton Head, there is plenty to do while waiting to enter the property. The new Beach Club,  Coligny Plaza, Shelter Cove, Harbour Town, South Beach Marina,and Hilton Head Beaches are the most visited spots on the Island and ideal for snacking,strolling and shopping.  Some of the Island's best restaurants, outdoor cafes,and nightly entertainments spots are located there.

 

A Keyless Entry System with a Touch/Combination Lock requiring a 4-digit code will be on the front door.  The code and instructions will be sent to you along with other Hilton Head Island information when your final payment is received.

 

Housekeepinig:  The Property is cleaned before you arrive and when you depart.  You will be provided with bath towels and bed linens.  A vacuum cleaner is stored inside.  Please do not use our linens and bed covers and blankets at the Beach.  Violation of this policy will result in charges to your credit card as these are not accidental damages. 

There is a full sized washer and dryer in the laundry area for your convenience.

 

Reservations/Security Deposit:

 

No Security Deposit is required when paying your first payment by credit card.  However, for damages  not deemed accidental -  these will be assessed and charged to your credit card on file.

Please see the Travel Guard Insurance options at the time of reservation.

 

 The balance of rent and any other fees are due 60 days before you arrive. Please mail a check to the owner. This information will be emailed to you. If you are booking this within 60 days of arrival, the total amount is due at time of booking.

 

Any damage noticed upon arrival should be reported to the owner immediately. If damage is not reported, you may be charged for the cost of the repair. All general maintenance should also be reported so the unit can be kept in good repair.

It is expected that:

 

a) No damage is done to the unit or its content including the linens.

b) No items are missing upon the inventory check.

c) All debris, garbage and discards are placed in proper containers

d) All soiled dishes are placed in the dishwasher.

e) There was no exceeding the maximum occupancy of the unit

f) There was no smoking or evidence of smoking

g) Unit is left in neat condition.

 

Travelguard Accidental Damage Insurance is just that: accidental.  The above a-g indicate some non-accidental issues.

 

SEVERE WEATHER:

We do not refund rents or deposits lost due to cancelled or shortened stays because of weather. Departures due to inclement weather do not warrant refund of rent or deposit.

 

Hurricane Policy and Tropical Storm Policy  

We do not offer any refunds for Hurricanes or Tropical Storms. We highly recommend getting TRAVEL Insurance for your trip. It is up to the Guest to purchase this coverage for their trip. 

Coverage is available for health and weather related problems.  Please order online to purchase this in your name.  

 

TRAVEL INSURANCE AND HURRICANES: WHAT’S COVERED?  

Travel insurance may cover a traveler’s vacation investment if severe weather conditions directly affect their travel arrangements or accom­mo­dations. For example, if a traveler is forced to cancel a trip due to a hurricane, travel insurance with trip cancellation can provide a reimbursement for nonrefundable expenses, up to the limit of coverage purchased.  

If severe weather forces the evacuation of the traveler’s unit, the travel insurance may provide reimbursement for nonrefundable expenses, and additional travel expenses. For losses to be covered, travel insurance must be purchased before a hurricane is forecasted or predicted. Once a storm is named, losses resulting from a hurricane that has been forecasted or predicted on or before the effective date of coverage are excluded.  

All claims will be evaluated on their own merits at the time of adjudication.  

 

Travel Insurance is available on this site and we highly recommend you purchase it.

 

Make Up Weeks - As a courtesy to our paid guests, we do offer a 4-week period during the Winter, Saturday after Thanksgiving until the Saturday before Christmas,( if not rented)  to make up any missed weeks due to any paid cancellations during the year.  Please inquire, if applicable.

 

Cancellation Policy:  In the event of cancellation of this contract, refund of any monies will be made only to the extent that a tenant can be found to occupy the vacated time at a comparable rate reserved under this contract.

 

  

PETS:

Only the pet (s) agreed to with the owner are permitted in our home under any circumstances, NO EXCEPTIONS. If any evidence of a non-approved pet(s) is found in our home or on the premises, you will be asked to vacate immediately with no refund of rent or damage deposit.

 

COMMUNITY RULES:

Guest agree to abide by rules of the community. These may be posted at the beach entrance. These rules may change from time to time.

 

INCLUSIVE FEES:

Rates include a one-time linen setup and cleaning service at the time of departure. There is NO DAILY MAID SERVICE.Arrangements can be made with the cleaning company for mid-stay cleaning. Guests will need to provide their own paper items and cleaning supplies. An initial set up of trash liners and toiletries is provided. Extra items needed are the responsibility of the guest. (ie Bring your tooth paste, laundry detergent, soap, extra toilet paper etc.)  We have left our own beach towels in an unlocked linen closet.  You are welcome to use them, but we ask that you please wash them and put them back.  If left for the cleaning service, they will be included with the regular linens, but do not have any identifying information on them, and will not be sent back to us.

UTILITIES:

The landlord will provide water, heat, electric, trash removal, wireless internet and telephone usage.

 

RESTRICTIONS:

No trailers, boats, jet skis, kayaks, or mobile homes

 

ACCOMMODATIONS:

Two  king,and  2 sets of twin beds and one sleep sofa.  GUEST supplies blankets for beach use. 

Twin beds can be doubled with a "doubler" attachment if requested in advance of the rental dates in either or both of the twin bedrooms

 

MAXIMUM NUMBER OF OCCUPANTS:

The house is to be occupied by no more than 10 (Ten) persons at a maximum.  We will not rent to vacationing students or singles under 25 years of age unless accompanied by an adult guardian or parent. No chaperoned groups VIOLATION OF THIS PROVISION SUBJECTS GUEST TO SIGNIFICANT PENALTIES WHICH ARE NECESSARY TO PROTECT THE LESSOR BECAUSE OF THE FACT THAT THIS LEASE IS A SHORT TERM  VACATION RENTAL.

  

FALSIFIED RESERVATIONS;

Any reservation obtained under false pretense will be subject to forfeiture of advance deposit and/or rental money and the party will not be permitted to check-in.

 

 

GUEST assures the LESSOR that the tenants will observe all conditions and terms of this lease as to maintaining the premises in good order and appearance and will conduct themselves in a manner inoffensive to neighbors. 

 

GUEST assures the LESSOR that any tenant who violates any of the terms of this Lease shall be immediately denied occupancy and shall remedy any damages or other expenses, which are caused by the tenant and/or the tenant's guest(s).   

 

GUEST agrees that any tenant who is found using drugs or allows others to use drugs on the premises will be immediately denied continued occupancy at these premises. 

 

GUEST and/or their guests shall not disturb, annoy, endanger, or inconvenience neighbors, nor use the premises for any immoral or unlawful purposes, nor violate any law or ordnance, nor commit waste or nuisance on or about the premises. 

 

GUEST agrees that during the term of this lease and such further time as he/she occupies the premises, he/she will keep the leased premises clean and free of trash, garbage, and other waste; and all pipes, wires, glass, plumbing and other equipment and fixtures in the same condition as at the beginning of, or may put in during the term of the lease, reasonable wear and tear and damage by unavoidable fire and casualty only exception. 

 

GUEST agrees to indemnify and save LESSOR harmless from all liability, loss or damage arising from any nuisance or harm made or suffered on the leased premises by the GUEST, tenants, or guests or from any carelessness, neglect, or improper conduct of any persons entering, occupying or visiting the leased premises.

 

GUEST agrees that he/she shall not paint or make alterations to the property, including changing existing locks or adding new ones, without the LESSOR'S written consent. 

 

Upon not less than 24 hours notice, GUEST shall make available to LESSOR or his agent for the premises of entering to make necessary or convenient repairs and to show the premises to prospective tenants.

 

In an emergency, LESSOR or his agent may enter the premises at any time without securing prior permission from GUEST.

 

GUEST may not let, sublet or assign this lease for all or any part of the premises without prior consent of the LESSOR. 

 

If GUEST abandons or vacates the premises, LESSOR may at his option terminate this lease, enter the premises, and remove all property. 

 

In the event that any action shall be commenced by either party arising out of, or concerning this lease or any right or obligation derived there from, the prevailing party shall be entitled to receive attorney's fees as fixed by the Court in addition to all relief at law or equity. 

 

Either party may terminate this lease in the event of a violation of early provision of this lease by the other party in the manner and as provided by law. 

 

The Policies and Procedures above are meant to protect our guests and the owners alike. All guests, as well as owners are required to conform to all Policies and Procedures.

 

GUEST assumes full responsibility for fulfilling the terms of the lease for the period stated and assure the LESSOR full recourse for the payment of any amount outstanding from the total amount due in accord with the terms as stated above including any outstanding or unpaid charges that are the responsibility of the GUEST. 

 

In the event of cancellation of this contract, refund of the advanced oayments will be made only  to the extent that a tenant call be found to occupy the vacated time reserved under this contract.

 

PENALTY FOR VIOLATING MAXIMUM OCCUPANCY PROVISION. VIOLATION OF THE  MAXIMUM OCCUPANCY PROVISION CAN RESULT IN SERIOUS HEALTH PROBLEMS DIRECTLY RELATED TO OVERUSE OF THE SEWER .THEREFORE, IN  THE EVENT GUEST ALLOWS THE PREMISES TO BE OCCUPIED BY MORE THAN TEN PERSONS, GUEST SHALL BE RESPONSIBLE TO PAY LESSOR.THE-SUM OF ONE HUNDRED ($100.00) DOLLARS PER PERSON IN EXCESS OF TEN PERSONS PER DAY FOR EACH DAY THE GUEST ALLOWS THE PREMISES TO BE OCCUPIED BY MORE THAN TEN PERSONS. 

 

 

 

CANCELLATION POLICY: Cancellation or changes of reservations with advance payments.

In the event of cancellation of this contract, refund of the advance rental deposit will be made only to the extent that a tenant call be found to occupy the vacated time reserved under this contract.

In the event of a cancellation less than  60 days of the check in date,  refund of the entire advance payment will be made only to the extent that a tenant call be found to occupy the vacated time reserved under this contract.

 Any changes that are made more than sixty (60) days prior to the check in date will not be penalized. Any changes made within (60) days of the check in date that result in a shortened stay, change of dates,  may result in loss of entire advance payment.

 

Cancellations and early departures due to inclement weather do not warrant any refund of rent.

 

 

 

CREDIT CARD AUTHORIZATION:

I understand and consent to the use of the credit card provided without original signature on the charge slip, I understand that by "clicking" that I have read the terms and conditions of this property, I am bound by this agreement and I have signed "electronically, and that this Credit Card Authorization cannot be revoked and will not terminate until 90 days after leased premises are vacated. Charges may include but not limited to: unauthorized telephone and  TV charges; damages beyond normal wear and tear; unreturned keys, and parking violations.

 

 

Insurance: You are expressly excluded from any insurance policy held by us. You understand that it is suggested that you carry renter's insurance to cover your personal belongings.

 

Maximum Occupancy: The maximum number of guests is 10. If you are found in breach of this contract, you will be evicted and no money will be refunded. Only people who have registered with us as a guest may stay overnight on the property.

 

 

 

 

Maintenance / Repairs: Even the best or newest equipment occasionally malfunctions and cannot be guaranteed 100% of the time. We have an excellent maintenance team who corrects problems as soon as possible. Authorized personnel may enter the premises during business hours for purposes connected with repairs, care, or maintenance of the premises. Expect lawn care personnel on property once a week.

Parking: You must park in designated parking areas only. 

No Smoking or Open Flame: No smoking is allowed inside the property. No candles or open flame of any kind are allowed inside the property. Upon departure, if the cleaning company detects any evidence of smoking and/or open flames,  additional fees may apply.

 

Conditions Beyond Our Control: We are not liable for events beyond our control which interfere with your scheduled occupancy, including, but not limited to: acts of God, acts of governmental agencies, fire, strikes, war, tornado, hurricanes, tropical storms, ice storm, severe weather, inclement weather, ferry boat cancellation, loss of electricity, or loss of water. There will be no refund in these circumstances. We recommend you purchase travel insurance prior to arrival.

Criminal Activity: You agree to not engage in any criminal conduct on the property, including but not limited to the following: usage of illegal drugs, committing a felony, violating any law or ordinance, disturbing the peace, engaging in conduct for unlawful purposes. We are not liable for any damage or injury you cause to yourself or a 3rd party while engaging in criminal activity.

Indemnification: We shall not be liable for any damage or injury suffered by you, your family, guests, invitees, agents or employees or to any person entering the property. You agree to indemnify, defend and hold us harmless from any and all claims or assertions of every kind and nature.

Governing Law: This agreement shall be governed, construed, and interpreted under the Laws of the State chosen by us.

Severability: If any part of this agreement is held to be invalid, such invalidity shall not affect the validity or enforceability of the rest of this agreement.

Falsified Reservations: If you provides false information concerning your identity or other aspects of the reservation, you will automatically forfeit the reservation and will not be granted access to the property. In addition, you will not be refunded any money paid in advance. We have a right to report the fraud to appropriate authorities.

Acknowledgement: You have read and agreed to the terms and conditions of this agreement including the vacation rental property rules, community rules, and weather/pet/smoking/cancellation policies. The credit card supplied at the time of reservation will be held for security purposes only.
